Welcome to Nowack Digital LLC, doing business as BBlingue ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our websites, products, services, digital courses, memberships, and community platforms, including those hosted on or powered by Kajabi (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Intellectual Property & Limited License

All content provided within our Services—including but not limited to videos, audio files, text, PDFs, downloadable templates, graphics, and design assets—is the property of Nowack Digital LLC and is protected by international copyright, trademark, and other intellectual property laws.

  • Grant of License: When you purchase or access a product, course, or membership, we grant you a single-user, non-exclusive, non-transferable, revocable license to access and view the content for your personal or internal business use.
  • Strict Restrictions: You are strictly prohibited from sharing your login credentials with third parties, downloading streaming content unless explicitly authorized, or copying, reselling, reproducing, or redistributing our materials. Violating this rule will result in immediate termination of your account without a refund.

2. Payments, Billing, & Subscription Terms

We offer individual digital products, structured payment plans, and recurring subscription plans. Payments are processed securely via our integrated third-party Merchants of Record and payment gateways, including but not limited to Stripe, PayPal, Hotmart, and Ebanx.

  • Payment Obligations: You agree to provide valid, complete, and up-to-date payment information. If a payment plan installment or recurring subscription billing fails, we reserve the right to immediately suspend or terminate your access to the platform and all associated content.
  • Subscription Cancellation: For ongoing membership subscriptions, you may cancel at any time through your account portal settings or by emailing our support desk. To avoid being charged for the next billing cycle, cancellation requests must be processed before your scheduled renewal date.

3. Global 7-Day Refund Policy & Warranty

We want you to be completely satisfied with your purchase, which is why we stand behind our products with a global limited warranty and refund window that aligns with international consumer protection standards.

  • The 7-Day Window: We offer a strict 7-day refund policy and warranty on all products. If you are unsatisfied with your digital product, course, or membership for any reason, you must submit a written refund request to our customer support team within exactly seven (7) days of your initial purchase date.
  • Forfeiture of Refund: Because digital assets can be consumed, accessed, and copied immediately upon purchase, refund requests received after the 7-day window has expired will not be honored under any circumstances, except where otherwise mandated by local statutory law.

4. User-Generated Content & Community Guidelines

Our platforms may include interactive areas, comment sections, forums, and community channels where users can interact, upload assets, and share thoughts.

  • Prohibited Behavior: You agree not to post, transmit, or share content that is unlawful, abusive, harassing, defamatory, or promotional of unrelated or competing business services (spam).
  • Right of Removal: Nowack Digital LLC retains the absolute right, but not the obligation, to monitor, edit, or delete any user-generated content or comments at our sole discretion, without prior notice.

5. Accountability, Suspension, & Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to our website, Kajabi portal, or community features at any time, without warning or liability, if we determine that you have breached these Terms, engaged in fraudulent activities, leaked intellectual property, or engaged in behavior that disrupts the community ecosystem.

6. Disclaimer of Warranties & Limitation of Liability

Except for the explicit 7-day warranty outlined in Section 3, all services and products are provided on an "as-is" and "as-available" basis without representations or warranties of any kind, either express or implied.

  • No Guarantees: Nowack Digital LLC does not guarantee specific results, revenue increases, pedagogical milestones, or financial outcomes from utilizing our digital strategies, courses, or advice.
  • Limitation of Liability: To the fullest extent permitted by law, Nowack Digital LLC’s total liability for any claims arising out of your use of the Services shall be strictly capped at the total amount you actually paid to us during the twelve (12) months preceding the event giving rise to liability.

7. Governing Law & Language Disclaimers

  • Governing Law: These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Missouri, United States, without regard to conflict of law principles. Any legal actions or proceedings arising under these Terms must be brought exclusively in a court of competent jurisdiction located in Missouri.
  • Language Conflicts: For the convenience of our international user base, these Terms may be translated into multiple languages (such as Portuguese). In the event of any conflict, discrepancy, or inconsistency between the English version and a translated version, the English version shall prevail and remain the legally binding master agreement.
